Privacy Policy
This Privacy Policy describes how Pal Consultancy Services ("we", "us", "our"), operating the FOMO platform at payfomo.in, collects, uses, shares, and protects your personal information. By using FOMO, you agree to the practices described in this policy. This policy applies to all users — including end users, partner venues, and influencer creators registered on the platform.
FOMO is a technology pass-through platform. We do not hold your money. All payments are processed and settled by Paytm Payment Gateway. We maintain a virtual ledger for discount credits, cashback rewards, and loyalty points only — this ledger holds no monetary value independent of a completed payment gateway transaction.
1. Information We Collect
1.1 Information You Provide — End Users
- Full name and mobile number at registration
- Email address (optional) for account recovery and notifications
- Date of birth for age verification and birthday rewards
- City and venue preferences for personalised recommendations
- UPI ID or payment method — collected and processed solely by Paytm PG; FOMO does not receive or store this
1.2 Information You Provide — Influencer Creators
- Full name, mobile number, and email address
- Social media handles and follower count at programme application
- PAN card number for TDS compliance on commission payouts above ₹50,000 per financial year
- Bank account details or Paytm wallet ID for commission payouts via Paytm Payouts
- Content category and audience demographics
1.3 Information You Provide — Merchant Partners
- Business name, GSTIN, FSSAI license number, and Shop & Establishment certificate
- Authorised signatory name, PAN, and address proof
- Bank account details for settlement via Paytm PG split settlement
- Venue photographs and operational details collected during Contact Point Verification
1.4 Information Collected Automatically
- Device information including device type, operating system, and unique device identifiers
- App usage data including screens visited, features used, and session duration
- Location data (only when you grant permission) to show nearby partner venues
- Transaction metadata: venue name, amount, discount applied, timestamp, promo code used — note: bank account numbers and UPI credentials are never received by FOMO
- Log data including IP address, app version, and crash reports
1.5 Information from Third Parties
- Payment confirmation data from Paytm PG: transaction ID, status, and amount
- Promo code attribution data linking influencer codes to transactions
- Social login data if you sign in via Google or similar providers
2. How We Use Your Information
2.1 For End Users
- To create and manage your FOMO account
- To process payments and apply discounts automatically at partner venues
- To maintain your virtual ledger showing discount credits, cashback, and FOMO points
- To send transactional notifications for payments and bookings
- To provide personalised venue recommendations based on your preferences and history
- To process prebookings and preorders at partner venues
- To enable bill splitting with friends through the platform
- To detect and prevent fraud and unauthorised account access
2.2 For Influencer Creators
- To track promo code usage and calculate commission earnings accurately
- To display earnings in the creator dashboard and earnings portal
- To process commission payouts to your registered Paytm wallet, UPI ID, or bank account via Paytm Payouts
- To deduct TDS as applicable under the Income Tax Act and issue Form 16A annually
- To send payout confirmation and earnings notifications
2.3 For Merchant Partners
- To onboard and verify your venue on the FOMO platform
- To process split settlements of transaction amounts via Paytm PG
- To provide venue analytics including transaction volumes, customer frequency, and discount utilisation
- To manage prebooking and preorder fulfilment notifications
2.4 General Platform Purposes
- To comply with the Information Technology Act 2000, DPDP Act 2023, and Income Tax Act
- To improve the platform through anonymised usage analytics
- To send promotional communications about new venues and features (opt-out available at any time)
3. Virtual Ledger and Creator Earnings Portal
We wish to be fully transparent about how balances displayed in the FOMO app work:
FOMO Balance (End Users)
- The FOMO Balance shown to end users represents accumulated discount credits, cashback from promotions, and referral rewards. It is a virtual ledger entry only — not a stored monetary value. It cannot be withdrawn as cash, transferred to a bank account, or sent to another user.
- End user FOMO Balance is redeemable only against future transactions at partner venues on the FOMO platform
- The ledger is updated only after Paytm PG confirms a successful real-world transaction
- FOMO does not hold any monetary value on behalf of users — all fund movement is exclusively through Paytm PG
Influencer Creator Earnings Portal
The Influencer Creator earnings portal shows pending and confirmed commission earnings. This is an accounting display only:
- Creator earnings shown in the portal represent amounts owed by FOMO to the creator from platform service fee revenue
- These earnings are not stored in any prepaid payment instrument
- Payouts are transferred directly to the creator's registered Paytm wallet, UPI ID, or bank account via Paytm Payouts on the monthly payout cycle
- The portal balance resets to zero after each successful payout
4. How We Share Your Information
We do not sell your personal data. We share information only as follows:
4.1 Paytm Payment Gateway
Transaction details are shared with Paytm PG solely to process payments and payouts. Paytm PG is bound by RBI guidelines and its own privacy policy.
4.2 Partner Venues
When you make a booking or payment, the venue receives booking confirmation and discounted amount. They do not receive your bank details, UPI ID, or full mobile number.
4.3 Influencer Creators
Creators receive anonymised aggregate data on code usage (number of uses, venue, total discount value). They do not receive individual user names, mobile numbers, or payment details.
4.4 Legal and Regulatory
We may disclose information to law enforcement, courts, the Income Tax Department, or RBI when required by law. We report suspicious transactions to FIU-IND as required under PMLA.
4.5 Business Transfers
In a merger or acquisition, your data may transfer to the acquiring entity under the same privacy protections.
5. Data Retention
- Account data: retained for the duration of your account and 3 years after deletion
- Transaction records: retained for 8 years for GST and financial compliance
- Creator TDS records: retained for 8 years for Income Tax compliance
- Merchant KYC documents: retained for 5 years after merchant offboarding
- Marketing preferences and opt-outs: retained indefinitely to honour your choices
6. Your Rights Under the DPDP Act 2023
- Right to access personal data we hold about you
- Right to correction of inaccurate or incomplete data
- Right to erasure, subject to legal retention requirements
- Right to grievance redressal through our Grievance Officer
- Right to nominate a person to exercise your rights in case of death or incapacity

7. Data Security
- All data transmission is encrypted using TLS 1.2 or higher
- FOMO does not store UPI IDs, bank account numbers, or payment credentials
- Access to personal data is restricted to personnel who need it to perform their duties
- Creator PAN and bank details are stored with encryption and accessed only for payout processing
- Periodic security assessments are conducted on our platform infrastructure

8. Children's Privacy
FOMO is not intended for users under 18 years of age. We do not knowingly collect data from minors. Contact legal@payfomo.in if you believe we have inadvertently done so.
9. Changes to This Policy
We will notify you through the app when we make material changes and update the Last Updated date. Continued use after the effective date constitutes acceptance.
